The Equal Rights Amendment (ERA) is a proposed amendment to the United States Constitution. Just twenty four words—it would ensure all people—women and men—are treated equally under the law. Currently, a person’s gender can influence the way law is applied. 

What is the Equal Rights Amendment and why do we need it?

WE ARE PROGRESSING TOWARD EQUALITY. DO WE STILL NEED THE ERA?

Yes.

  • As an amendment to the United States constitution, the Equal Rights Amendment is the permanent protection for gender equality.
  • This amendment would require a higher judicial standard of equal treatment for women and men by holding gender discrimination to a “strict scrutiny” standard in court cases.
    • Other distinguished groups, race, religion and national origin, are protected by “strict scrutiny” under the law, while “sex” is only “intermediate scrutiny” – lower legal standard.
  • Utah’s state constitution included an equality clause in 1895. But the nation has yet to follow suit–the Equal Rights Amendment would be that.
